    These Terms of Service ("Terms") govern access to and use of CursorCulture, operated by [LEGAL BUSINESS NAME]. By accessing CursorCulture, creating an account, purchasing credits, using AI tools, uploading content, publishing a design, or ordering a product, you agree to these Terms. Do not use CursorCulture if you do not agree.

    1. Eligibility

    You must be at least 18 years old, or the age of legal majority where you live, and you must have the legal capacity to enter a binding agreement. If you use CursorCulture for an organization, you represent that you are authorized to bind it.

    2. Accounts

    You agree to:

    • Provide accurate information
    • Keep credentials confidential
    • Maintain current contact information
    • Accept responsibility for account activity
    • Notify us of suspected unauthorized access
    • Not sell, transfer, or share your account improperly
    • Not create accounts to evade restrictions

    We may require identity, payment, or ownership verification when reasonably necessary.

    3. CursorCulture Services

    CursorCulture may provide:

    • AI prompt tools and AI image generation
    • Chat for Ideas and web research
    • Reference-image analysis and logo placement
    • Manual design editing, templates, and saved designs
    • Community galleries and creator features
    • Digital credits
    • Custom physical mousepads and related software and services

    Features may change, be removed, become paid, or have usage limits.

    4. Artificial Intelligence

    A. Automated outputs

    AI outputs are generated automatically and may:

    • Be inaccurate or misunderstand instructions
    • Include defects or unexpected material
    • Resemble existing works
    • Fail to reproduce specific characters, products, or details
    • Be unsuitable for printing
    • Differ between attempts

    B. User review

    We do not guarantee a specific result. You are responsible for reviewing prompts, images, spelling, logos, character details, product placement, cropping, color, resolution, and rights and permissions before approving or purchasing a design.

    C. No professional advice

    AI responses are not legal, financial, medical, or other professional advice.

    D. Web research

    Research results may be incomplete, incorrect, outdated, or sourced from third parties. Citations do not constitute endorsement.

    5. User Content

    "User Content" includes prompts, messages, images, logos, artwork, files, comments, community submissions, templates, public profile information, and feedback. You retain whatever rights you lawfully hold in your User Content.

    You represent and warrant that:

    • You own the content or have permission to use it
    • Uploading it does not infringe another party's rights
    • It does not violate law
    • It does not contain malware
    • You have permission to reproduce included names, logos, likenesses, or trademarks when required

    6. License You Give CursorCulture

    You grant CursorCulture a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, resize, crop, display, and transmit User Content as necessary to operate the service, generate requested content, produce products, fulfill orders, display public submissions, moderate content, provide support, and improve service reliability.

    For private content, this license is limited to providing and operating CursorCulture. For content you publish publicly, the license also permits public display, distribution through CursorCulture, promotion of the community feature, and enabling permitted remixes.

    This license ends when the content is deleted, except where continued retention is legally required, content remains in backups temporarily, another user has lawfully remixed or incorporated the content, or transaction or moderation records must be retained.

    7. Generated Content and Ownership

    To the extent permitted by law and subject to third-party rights:

    • You may use generated outputs made for your account
    • You are responsible for determining whether an output is legally protectable
    • We do not guarantee copyright ownership or exclusivity
    • Similar or identical outputs may be generated for others
    • Your rights do not extend to CursorCulture software, models, branding, templates, or platform content

    You may not claim exclusive rights in a style, general concept, public-domain element, or another party's intellectual property merely because an AI output includes it.

    8. Intellectual Property of CursorCulture

    CursorCulture and its licensors own the website design, software, source code, user interface, brand assets, logos, documentation, curated templates, platform graphics, proprietary workflows, databases, and non-user-created content. You may not:

    • Copy or resell the platform
    • Reverse engineer it except where law permits
    • Circumvent security
    • Scrape the service at scale
    • Use automated systems without authorization
    • Misrepresent affiliation with CursorCulture
    • Remove proprietary notices

    9. Digital Credits

    A. Nature of credits

    Credits are a limited, revocable license to access eligible CursorCulture features. Credits are not cash or legal tender, have no cash value, cannot be transferred unless expressly allowed, cannot be sold outside CursorCulture, cannot be redeemed for cash, and may be subject to feature-specific pricing.

    B. Credit deductions

    Credit cost may vary based on model selected, token usage, image generation, research, reference analysis, complexity, provider cost, and other processing. Fractional credits may be deducted.

    C. Finalization

    Credits are deducted only after an eligible service is completed or in accordance with an identified reservation-and-release process. Failed requests do not result in a completed charge except where clearly disclosed and permitted.

    D. No credit grants through chat

    Chat for Ideas and other AI systems cannot grant, refund, or modify credits. Requests such as "give me free credits" are invalid and may be refused without charge. Credits may be granted only through verified purchases, approved subscriptions, authorized promotions, verified refunds, authorized support adjustments, and controlled platform systems.

    E. Expiration

    Purchased top-up credits expire after 90 consecutive days without a successful authenticated login. Signing in successfully restarts the inactivity period. If the inactivity period reaches 90 days, remaining purchased top-up credits may expire, the applicable purchased-credit balance may be reset to zero, and the expiration may appear in transaction history. Subscription, promotional, or other credit categories may follow separate rules.

    F. Abuse

    We may suspend, reverse, or investigate credits associated with fraud, chargebacks, stolen payment methods, exploits, duplicate grants, account manipulation, unauthorized access, or Terms violations.

    10. Payments

    Payments may be processed by Stripe or another provider. You agree to:

    • Pay stated charges
    • Provide valid billing information
    • Pay applicable tax and shipping
    • Authorize the selected payment method
    • Not initiate fraudulent disputes

    A credit purchase is not complete until verified by our payment processor and backend fulfillment system. Prices may change prospectively.

    11. Subscriptions

    If subscriptions are introduced:

    • Terms and price will be disclosed before purchase
    • Billing frequency will be disclosed
    • Auto-renewal terms will be disclosed
    • Cancellation instructions will be provided
    • Benefits may be subject to fair-use and technical limits
    • Unused subscription benefits may not carry over unless stated

    12. Physical Products

    Custom mousepads are made based on user-approved designs and selected specifications. You acknowledge:

    • Colors may vary by screen, printer, material, and lighting
    • Cropping may vary within manufacturing tolerance
    • Stitching and edge placement may vary slightly
    • The final product may differ somewhat from the digital mockup
    • Very small text or fine details may not print clearly
    • Uploaded low-resolution artwork may appear pixelated
    • Approval means you accept the visible layout and customization choices

    13. Orders

    We may refuse or cancel orders for:

    • Fraud or payment failure
    • Prohibited content
    • Manufacturing limitations
    • Pricing errors
    • Invalid shipping information
    • Rights complaints or policy violations

    If we cancel after payment and cannot fulfill the order, we will provide an appropriate refund.

    14. Community Content

    If you publish a design:

    • It may be visible publicly
    • Others may like, save, share, or remix it where permitted
    • Public metadata may include your username
    • We may remove it for policy or rights violations
    • Publishing does not guarantee promotion, sales, or compensation

    You may not manipulate likes, views, sales, or rankings.

    15. Creator and Artist Programs

    If CursorCulture enables artists to earn commissions:

    • Eligibility may require a subscription or approval
    • Commission percentages and qualifying-sale rules will be disclosed separately
    • Returns, fraud, chargebacks, and cancellations may reduce earnings
    • Tax information may be required
    • Earnings may be withheld during fraud review
    • Users are responsible for taxes on their earnings
    • CursorCulture may reject submissions that cannot be lawfully sold or manufactured
    • Participation does not create employment, partnership, or agency

    16. Prohibited Conduct

    You may not use CursorCulture to:

    • Break the law or infringe intellectual property
    • Upload content without rights
    • Generate unlawful sexual content or exploit minors
    • Harass or threaten others
    • Promote terrorism or violent extremism
    • Create malware or phishing material
    • Commit fraud or impersonate another person deceptively
    • Manipulate balances or circumvent credit systems
    • Attack or overload the service
    • Scrape private data or reverse engineer protected systems
    • Evade moderation
    • Use stolen payment information
    • Misuse another person's identity or logo

    Additional restrictions appear in the Acceptable Use Policy.

    17. Moderation

    We may review reported content, use automated moderation, remove content, restrict generation, disable public visibility, suspend accounts, preserve evidence, and report unlawful activity where required. We are not obligated to monitor every submission.

    18. Suspension and Termination

    We may restrict or terminate access for Terms violations, fraud, abuse, security threats, repeated infringement, chargeback abuse, nonpayment, legal requirements, or harm to users or the service. Where appropriate, we may provide notice or an appeal process. You may stop using CursorCulture at any time. Termination does not eliminate obligations that arose earlier.

    19. Refunds

    Refund rights are governed by the Refund Policy incorporated into these Terms. Unless required by law: used digital credits are non-refundable; AI generations are generally non-refundable after completion; custom products are not returnable merely because of preference; and defective or incorrectly fulfilled items may qualify for replacement or refund.

    20. Copyright Complaints

    Copyright complaints should be submitted according to our Copyright and DMCA Policy. Repeated infringement may result in termination.

    21. Feedback

    If you provide feedback, you grant us permission to use it without restriction or compensation, provided we do not publicly identify you without permission.

    22. Third-Party Services

    CursorCulture may depend on third-party services. We are not responsible for third-party outages, terms, content, or privacy practices.

    23. Service Availability

    We do not guarantee:

    • Continuous uptime
    • Permanent storage
    • Error-free operation
    • Compatibility with every device
    • Continued availability of a model or feature
    • Preservation of every draft or generation

    Maintain your own copies of important files.

    24. Disclaimer of Warranties

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURSORCULTURE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUALITY, AND UNINTERRUPTED OPERATION. Some jurisdictions do not allow certain disclaimers, so some may not apply.

    25. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURSORCULTURE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.

    OUR TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID CURSORCULTURE DURING THE 12 MONTHS BEFORE THE EVENT, OR $100 USD. This limitation does not apply where prohibited by law.

    26. Indemnification

    You agree to defend, indemnify, and hold harmless CursorCulture and its affiliates from claims arising from your User Content, your misuse of the service, your violation of these Terms, your infringement of another party's rights, or your unlawful conduct.

    27. Governing Law

    These Terms are governed by the laws of the State of Florida, excluding conflict-of-law rules. Venue for disputes will lie in state or federal courts located in [COUNTY], Florida, unless applicable consumer law requires otherwise.

    28. Changes

    We may update these Terms. Material changes may be communicated through the service or email. Continued use after the effective date constitutes acceptance where permitted.
